Terms & Conditions

The terms that apply to this website and to our client engagements.

Using this website

By accessing this website you agree to these terms. If you do not agree, please stop using the site.

You may not use the site to attempt unauthorised access, disrupt its operation, scrape content at scale, or submit false or misleading enquiry information.

Enquiries and no automatic engagement

Submitting a form or booking a strategy call does not create a client relationship. An engagement begins only when scope, fees and timelines are confirmed in writing by both parties.

Scope of services

Deliverables, channels, review cycles and reporting are defined in the proposal or agreement for each engagement. Anything outside that document is treated as a change request and quoted separately.

Fees and payment

Fees, billing cycle and payment terms are set out in the applicable proposal or invoice. Advertising spend on platforms such as Google or Meta is billed separately from our service fees unless stated otherwise.

Delayed payment may result in work being paused until the account is settled.

Client responsibilities

Timely access to accounts, brand assets, approvals and feedback is required to keep delivery on schedule. Delays in approvals may shift timelines.

You confirm that any content, logos or material you provide is either owned by you or properly licensed.

Results and performance

Digital marketing outcomes depend on market conditions, competition, budget, platform policies and factors outside our control. We commit to defined activity, reporting and best practice — not to guaranteed rankings, revenue or lead volumes.

Intellectual property

Content, code and creative produced for an engagement transfer to the client on full payment, except for third-party licences, frameworks and our internal tooling, templates and methodology, which remain ours.

All content on this website, including copy, design and brand marks, belongs to TenX Digitech.

Confidentiality

Both parties agree to keep commercial, strategic and technical information shared during an engagement confidential, and to use it only for the purpose of delivering the work.

Third-party platforms

Our work may rely on platforms such as Google, Meta, LinkedIn, WhatsApp, CRMs and hosting providers. Their policies, pricing, outages and account decisions are outside our control.

Limitation of liability

To the extent permitted by law, our total liability for any claim arising from an engagement is limited to the fees paid to us for the three months preceding the claim. We are not liable for indirect or consequential losses, including lost profits.

Termination

Either party may end an engagement with the notice period stated in the agreement. Fees for work completed and committed costs up to the end of the notice period remain payable.

Governing law

These terms are governed by the laws of India. Courts at Kolkata, West Bengal have exclusive jurisdiction over any dispute.
